Rules of Participation and Indemnity

The ‘USN Body & Lifestyle Challenge’ is a self-improvement Challenge comprising body measurements, a written report and ’before and after’ photographs. The ‘USN Body & Lifestyle Challenge’ will be conducted in South Africa. International participants are also welcome and all prizes and conditions will remain as in South Africa.

The USN Challenge can be entered by means of the Challenge Passport (in hardcopy) or by completing the process online at www.usnchallenge.co.za

An e-mail confirming registration will be forwarded to all participants once their registrations have been received.

All Challenge Passports and their content, once received, become the sole and exclusive property of Ultimate Sports Nutrition (PTY) Ltd.

Entrants must be 18 years or older on date of entry.

Participants may enter the Challenge more than once provided they register again and that the 12 week transformation program doesn’t overlap with a previous one. Each program must therefore be completed before the next one is started – which will include new “before” and “after” photos.

Like with all training and nutritional plans, you are advised to consult your physician before entering the USN Body & Lifestyle Challenge.

Employees of USN, its distributors, consultants, suppliers and any person providing services to the USN Body & Lifestyle Challenge along with their immediate family members, are not allowed to compete in the USN Body & Lifestyle Challenge. However, all employees working in USN outlets (pharmacies, health shops, etc) are allowed to enter the Challenge.

Only USN products must be used in the 'USN Body & Lifestyle Challenge'. Proof of purchase of the USN products (receipts) should be kept after the Challenge and will be required from all finalists.

All prescription medicine used during the "USN Body & Lifestyle Challenge" transformation program must be disclosed together with a medical certificate indicating the purpose for which such prescription medicine was used. Failure to do so will result in immediate disqualification. No anabolic steroids or any other prohibited performance enhancing substances may be used at any time during the Challenge and failure to comply with this rule will lead to immediate disqualification.

All participants entering the USN Body & Lifestyle Challenge unconditionally consent to being drug tested by an agency selected by USN.

All participants must notify USN of any change to their current residential or contact details.

USN may at its sole and absolute discretion and without offering any reasons, decline an entry received from anybody including (but not limited to) anyone who is under suspension or has been banned by any sports controlling body for having used illegal drugs or any other banned substances or procedures.

A participant may not sell or transfer in any manner whatsoever his entry or allow anyone else to participate under his name and any participant in breach of this regulation will be banned from participating in this and any future USN Body & Lifestyle Challenges.

Submission of the Challenge Passport to USN grants USN and its agents in terms of Section 51 of the Electronic Communications Transactions Act the right to use all personal information of the competitor and his/her photographs and reports free of charge for whatever use in any media whatsoever.

Please note that USN does not sell or rent personal information of participants to third parties. USN may however disclose your personal information to a third party where - it is compelled by law or a court order to do so or when it believes that such action is necessary for the purposes of its legitimate interests to protect and defend its rights, property or safety, the USN Website, visitors to the USN Website or others;or such third party is used to provide services to USN, e.g. USN may use a third party to distribute its publications and if a participant has indicated that he/she wishes to receive a USN publication, that third party would be provided with the participant’s mailing address.

RELEASE, WAIVER AND INDEMNITY

Each participant assumes all risk of injury, harm or loss of any kind arising from participation in the "USN Body & Lifestyle Challenge" including the use of any information, advice, training tips or programs, as well as the use of any and all USN products supplied by USN and/or any of its employees, agents or representatives. USN shall under no circumstances whatsoever be liable to any participant including, without limitation, as a result of or in connection with its negligent (including grossly negligent) acts or omissions or those of their employees, agents or designees or other persons for whom in law they may be liable (in whose favour this constitutes a contract or undertaking for their benefit) for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused (whether arising under contract, delict or otherwise and whether the loss was actually foreseen or reasonably foreseeable), sustained by the participant competing in the USN Body & Lifestyle Challenge. USN, its members, employees, designees, agents, affiliates, representatives and/or suppliers shall not be liable for any loss, damage (whether direct, indirect or consequential) or expense of any nature whatsoever which may be suffered as a result of or which may be attributable, directly or indirectly, to the use of or reliance upon the USN Website (including any information contained thereon) or elsewhere on the Internet.

Participants hereby indemnify and keep USN indemnified from and against any loss or damage suffered or liability incurred including, without limitation, in respect of any claim or demand by any third party by reason of any act or omission on the part of the participant or that of any family member, agent or representative acting on his/her behalf in connection with this Challenge.

Any changes made to these Rules will be published on the USN website at www.usnchallenge.co.za.

All scores and measurements of participants will be kept confidential and will not be disclosed. USN will be the sole interpreter of the Rules and may change it in the interest of the competition and/or whenever fairness so requires. All decisions made by USN with regard to the participants and the announcement of the catagory finalists and winners are final and binding.

Failure to comply with any of the foregoing rules may result in disqualification.

These Rules are governed by the laws of the Republic of South Africa and constitute the whole agreement between the parties.

Any indulgence or extension of time granted by USN shall not be construed as a waiver or variation of any of its rights or remedies.

Judging

The Judges appointed by the USN Body & Lifestyle Challenge will select the finalists. USN will decide on a panel to select the Body & Lifestyle winner.

Terms and conditions apply to certain of the prizes to be won.

Entrants will be judged within the following Categories:
Best Male,
Best Female,
Best Couple,
Best over 50 year old

None of the prizes are transferable and there will be no substitutions for any of the prizes.
